Who fired first? And did he point the gun at sheriff's deputies? All key points of testimony Tuesday as Christian Patterson took the stand for a second day in his murder trial. He's accused of killing an Oneida County sheriff's deputy after a standoff in June. Our Sarah Blazonis was in the courtroom and has more on testimony from both sides that isn't matching up.

ONEIDA COUNTY, N.Y. -- Several hours into his armed standoff with police, Christian Patterson said he got cold. He said he'd just put on a jacket and put his hand back on the trigger of his shotgun when it happened.

Defendant, Christian Patterson said, “I was shot. They shot me. Somebody shot me one, two, three times."

Patterson said that's when his gun accidentally went off, killing Dep. Kurt Wyman. He said he didn't mean to harm Wyman and couldn't even see he was there because of a police spotlight. But that wasn't the only shot he fired.

"I believe I pulled the trigger on that one, the second shot. After that, my arms just went limp," said Patterson.

"Do you recall the testimony of the officers that there were three shells on the ground? Do you recollect firing three times?” asked Defense Attorney Frank Nebush.

"No. I didn't fire three times,” replied Patterson.

That's a very different story than the ones told by law enforcement officers. Several testified they fired two non-lethal rounds at Patterson first and only once his hand finally left the trigger. Patterson told prosecutors that was a lie. He also said officers broke his arm, wrist, and fingers while handcuffing him, something prosecutors disputed during cross examination.

"Isn't it a fact that your arm was shattered by buckshot?" said Michael Coluzza, First Assistant District Attorney.

"I don’t believe so, sir," said Patterson.

"Isn't it a fact that your own medical records show fractures secondary to gunshot,” said Coluzza.

Patterson replied, "I do not know. I did not see my medical records."

Prosecutors also said if the gun was in the position Patterson said it was before his first shot, he would've struck his lawn tractor and not Deputy Wyman.

Patterson also testified he initially got his gun because he planned to kill himself, not because he wanted to kill anyone. Prosecutors asked ‘why, then did he load several bullets in the gun and put more in his pocket’. Patterson responded that it was a force of habit from hunting.
