CHENANGO COUNTY, N.Y. -- Peter Wlasiuk will not be sentenced until November 17th. The Oxford man faces anywhere from 25 years to life in prison for the 2002 death of his wife, Patricia.

Two of Patricia's family members requested to address Wlasiuk before he received his sentence, but the request was not made early enough for Tuesday's sentencing. Patricia's mother says she is exasperated with the move and wants to see justice served.

"When they first came to me and said there were questionable things I said, 'Oh no, he wouldn't do something like that.' Well, if I had my doubts then, they are long gone. Because he would lie about anything and has," said Joyce Cardozo, Patricia's mother.

Peter Wlasiuk's family also says they're worn out with the trial's duration. Wlasiuk was first found guilty of murder back in 2002, but the case was thrown out four years later on a technicality.

"I love my son, I love my daughter-in-law, I love my grandchildren and this is not just, this is not justice. They should let him go home already," said Thomas Wlasiuk, Peter's father.

The postponement gives the defense time to work on their argument. They believe there was juror misconduct and say a new trial should be granted.

"These issues are before a jury in a circumstantial evidence case where they have to exclude every reasonable hypothesis of innocence and they're asking a guy questions who's on the jury, who's a foot doctor, he's a podiatrist, he's not a medical doctor," said Randy Scharf, Wlasiuk's defense attorney.

Scharf says he'll request a separate hearing on the matter.
