Lawyer wants Molina out on bail
CHEMUNG COUNTY, N.Y. -- The lawyer for one of the suspects charged in a shooting that killed an innocent man in his sleep wants his client allowed out of jail on bail.

Demetrius Molina, 23, and Romondo Ross, 24, are charged with second-degree murder in the August death of 51-year-old Maurice Davis. In court Monday, Molina's lawyer says Molina was not involved in the shooting at Hathorn Court. The lawyer says only inconsistent statements from two witnesses tie Molina to the crime, which isn't enough to warrant keeping him in jail.

"You have an innocent man behind bars right now. This is a difficult situation for his family. He's hanging in there as best he can. But this happens," said Lawrence Fredella, attorney for Molina.

"We believe at the time he was picked up, he intended to flee the area as evidenced by certain evidence, certain facts that were given to us by the arresting officers. And we just thought bail would not be appropriate at this point," said Chemung County District Attorney Weeden Wetmore.

The judge sent Molina back to the Chemung County Jail without bail for now, but that could change after the judge reviews the grand jury minutes. Ross also returned to jail without bail.

The two are due back in court in January, with a trial tentatively set for April.
