It's been 14 months since the murder on New York Avenue in Ogdensburg. And the man accused of killing his neighbor told his side of the story in a heated courtroom Thursday.

Wayne Oxley, of Ogdensburg, is accused of beating Bernard Trickey to death with a baseball bat.

Oxley said the last time he was at Trickey's house was two days before the murder to buy cocaine. Oxley also told the jury John Shannon, who died one month later in a mysterious fire, borrowed his baseball bat.

But after the judge made a ruling on the prosecution's side, Oxley blurted out to the judge, "I'm trying to defend myself, you are not letting me defend myself."

The judge responded he can prevent Oxley from taking the stand.
The defense lawyer told Oxley twice to be quiet for speaking up to the judge.

Defense attorney Richard Manning said, "The judge was making a comment and he thought he was the one supposed to be answering the question. It was a query by the judge. And he didn't understand, so that's why I told him to be quiet and listen."

The defense attorney said he may call more witnesses to the stand after cross-examination when trial continues Monday.
