The re-trial of accused murderer Wayne Oxley is underway in the North Country. Jury selection started Tuesday at St. Lawrence County Court. Oxley was found guilty in 2006 for murdering his neighbor, but the verdict was overturned. Our Rachael Paradis takes a look at this on-going case and what the next few weeks will bring.

OGDENSBURG, N.Y. -- It's been five years since Bernard Trickey Jr. was murdered at his Ogdensburg home. His neighbor, Wayne Oxley, is accused of beating him to death with a baseball bat.

Oxley was found guilty in 2006, but the conviction was overturned after it was determined a judge wouldn't allow a witness to testify. The re-trial began Tuesday with a jury selection that could take several days.

In the first trial, police say they found the murder weapon in Oxley's basement one day after the murder and an inmate also testified that Oxley confessed in jail. However, his lawyer, Richard Manning, said that neither his client's blood nor the victim's blood was found on Oxley's clothing. The defense also claims another person named Chase Webb admitted to the killing.

During that first trial, neighbors said they stand by Oxley and believe he is innocent.

After his conviction was overturned, he was set free on $75,000 bail. His future now depends on the 12 men and women selected for the re-trial.

Judge Jerome Richards says the trial could last as long as three months.
