Trial date set for Megabus driver

ONONDAGA COUNTY, N.Y. -- A trial date has been set for the driver involved in last year's deadly Megabus crash. John Tomaszewski's trial is set for February 6th.

Tomaszewski wasn't in court this morning because of a heart condition and his lawyer was granted a medical waiver. That is the reason that the trial date isn't until February.

Tomaszewski appeared in Onondaga County Court earlier this month, and the judge threw out a motion by his attorney to have the charges dismissed.

Tomaszewki faces four counts of criminally negligent homicide for the crash that happened just over a year ago. He was driving the double-decker bus from Philadelphia to Syracuse when he missed a turn and ended up on the Onondaga Lake Parkway. The bus hit a low bridge, killing four people and injuring many more.

Tomaszewski will be back in court in October for a hearing on what evidence will be allowed during the trial.
