The Wayne Oxley re-trial is more than half way through, as witnesses for the defense continue to take the stand. This is Oxley's third trial to determine whether or not he is guilty of killing Bernard Trickey Jr back in 2005. Trickey was beaten to death with a baseball bat at his Ogdensburg home. On Tuesday, five witnesses testified, and our Cara Thomas tells us the defense hopes to point the finger toward someone else.

CANTON, N.Y. -- Eight witnesses have taken the stand for the defense so far in the trial and on Tuesday, Wayne Oxley's attorneys began calling witnesses who they say help lay a foundation for someone else killing Bernard Trickey Jr.

Trickey was killed in his home in August of 2005 after he was beaten to death with a baseball bat.

In most of the testimonies heard by the defense so far, friends and neighbors say they saw Oxley at his home most of the evening of the murder, drinking wine, taking pills and smoking marijuana. But on Tuesday, some witnesses were called, not to talk about Oxley but to point the finger elsewhere.

One of the witnesses took the stand without the jury present and has asked to remain anonymous after she was sent threats on her children's lives. She claims another man, Robert Webb, told her he planned to kill Trickey two weeks prior and then admitted to killing him after the fact.

Over the past three trials, she has yet to testify in front of the jury and the defense says they hope this trial will be different.

The defense said there are other witnesses with a similar testimony who will take the stand over the next few days.
