ELMIRA, N.Y. -- The state Supreme Court has overturned the conviction of a man found guilty in a murder at Elmira's Hathorn Court apartments.

Romondo Ross was convicted three years ago for the 2008 murder of Maurice Davis. Davis was asleep in his apartment when a stray bullet traveled through the wall and killed him.

Ross and a man named Demetrius Molina were both convicted of murder and manslaughter. They were part of a fight that night and fired several shots outside Davis' apartment.

Both men were sentenced to 17 and a half years in prison.

But in 2010, the Appellate Division overturned Molina's conviction, saying the court erred when it charged him with intentional murder and depraved indifference at the same time. And based on that decision, the court has now overturned Ross' conviction as well.

Ross, who remains in prison, faces a possible retrial for manslaughter.
